Know the Law for Accepting Credit Card Payments!

Now that you have your credit card terminals in place and you’re free to accept credit cards, you will be attracting more business through your door from people who insist on using their credit card because they know their rights under Section 75. It’s important to know the loopholes and exceptions when it comes to dealing with Section 75 claims. The following 4 points provide scenarios in which the legal protection of the customer under Section 75 becomes invalid…

• Third party purchases are where credit card payments go to an organisation that is not supplying the goods or service. You’re unlikely to make a successful claim when a credit card   is used for payments to a third party company because the credit card company ( bank ) must have a direct relationship with the supplier of the goods or service for them to be equally liable. However, when booking a flight through a travel agent, customers are likely to make a successful claim should the chosen airline go into liquidation before the service is provided.

• Third party purchases are where credit card payments go to an organisation that is not supplying the goods or service. You’re unlikely to make a successful claim when a credit card   is used for payments to a third party company because the credit card company ( bank ) must have a direct relationship with the supplier of the goods or service for them to be equally liable. However, when booking a flight through a travel agent, customers are likely to make a successful claim should the chosen airline go into liquidation before the service is provided.

• There are such instances when a claim will be made for a goods or services that does not directly benefit the primary card holder. These claims would not be successful. Any card that is set up by person A for the use of person B, like a child or friend, which is used in payment of an item not intended for person A will not be protected by Section 75.

• Credit card payments for land are regulated by the Financial Services Authority. Therefore, this indirect relationship will also sever any ties with Section 75 law.

• And finally, credit card cheques or payments made with cash withdrawals will also fall short of any protection under this legislation.

Other than these, the customer is likely to make a successful claim – though of course each claim will vary from the next – so ensure you’re clued up on the card holder’s rights when you begin card processing.

It’s also important to remember that the holder can pay only a fraction of the total amount for any one good or service on their credit card, perhaps in the form of a deposit, in order to gain legal protection in a transaction that goes wrong. And credit card payments for goods overseas are protected as well!

Clearly, with these rights in place, customers are far more willing to invest the time in applying for their own cards, so should you not accept credit cards yourself a major opportunity will be lost. Why You Should Accept Cards


Credit Card Purchases:


As a small business if you do not accept cards from your customers you are probably loosing valuable sales from customers who prefer to use credit cards instead of cash or cheques because they know their rights under Section 75 should something go wrong with the purchase

What is Section 75?

The next series of posts focuses on credit card purchases, specifically exploring the ramifications of the law specified in ‘Section 75’ of the Consumer credit Act 1974.

Section 75 is a piece of legislation that states a credit card issuer ( bank ) can be held equally liable in a credit card transaction for faulty goods, should the credit card payment exist within the boundary of £100-£30,000. For example, the value of an order placed with an online retailer worth £500 will be refunded by the issuer, if the retailer were to go out of business before delivery of the purchase. The regulation will also apply if  goods are broken upon delivery or a service has been falsely advertised, etc. Claims can be made whether the customer has paid through a physical card machine or a virtual terminal.

So, by making use of card payments on a regular basis, the customer is far more likely to be protected by law if the transaction does not bear the fruit intended. If unsure as to whether entitled to a section 75 claim, credit card holders should check if a Debtor-Creditor-Supplier agreement is in place when the transaction is made – this is the indisputable link between the credit card payment and the goods or service purchased; effectively, it is proof to the finance company of the direct relationship between the two parties. Bank loans are an example of indirect funding, so the law does not protect the card holder in these cases, regardless of the value of the loan.

Another pitfall is in regard of the interest that issuers charge with every transaction. Its value, in most cases, will often compensate for the claim itself and protection becomes useless anyway. Experts suggest avoiding this by setting up a monthly direct debit that pays off the card so as not to have to pay interest at all.

In the cases of debit and prepaid cards, or a credit card payment of value below £100, section 75 does not apply, although alternatively card holders may be able to claim chargeback, in which a supplier’s own bank offers money back for faulty card payments. More often than not, card holders will make this claim when they believe a transaction has been authorised without their knowledge.

Section 75 is but another form of card processing solutions for the card holder and a vital piece of legislation that it pays to become familiar with. Consumers have become very aware of their rights when making purchases and are more likely to use a card when making a purchase.

Merchant Account

As we have discussed many times throughout previous blog posts, Seymour Direct can organise everything you need to start accepting credit & debit cards, such as organising a Customer Present Merchant Account, an Online Merchant Account and of course provide access to PCI compliant credit card machines.

The merchant account is provided by an ‘acquiring bank’, they communicate directly with the card issuer when authorizing transactions and are essentially taking all the risk involved in accepting your business.

An acquiring merchant bank such ‘Natwest Streamline’ will handle all of the payments incoming from customers issuing banks, this means that you will no longer have to worry about delays from various banks processing policies.  The acquirer provides you with what is known as ‘a line of credit’ where they will pay you for a particular period before they have received the funds from the issuer.

A merchant account is different from a regular account in the fact that you cannot withdraw funds at will, this is scheduled by the merchant bank at a time arranged with you or your payment provider. These security precautions are necessary and the bank will want to be sure that they will receive funds from the customers banks, all of this is taken into account in the initial approval process.

At the time when a customer makes a purchase at your store, the acquiring bank contacts the card association to verify the credit card ownership and also to notify the card holders bank that they have made a charge.  The credit card provider can decline the authorization of payment if the customer has maxed out their spending limit, since risk is also involved on their part.

The main risks that are taken into account when approving an application for a merchant account are what threat does your business pose in terms of potential fraudulent transactions. Even though all businesses that accept credit cards must be PCI compliant there are still factors that come into consideration when deciding the discount rates to be applied to each card transaction.

PCI Compliance

Many small business owners hear about the term ‘PCI compliance’ and wonder what it actually stands for, the ‘Payment Card Industry – Data Security Standards’ or PCI DSS is an information security regulation which organizations must abide by when handling credit card data.

It is a common for merchant’s who want to meet PCI compliance to think that the documentation procedure is the easiest part of the requirement’s, sure, Seymour Direct can supply you with PCI compliant credit card machines but this is useless if your staff don’t understand the policies and procedures put in place.

Your method might be to simply cross off each of the PCI guidelines in order to gain compliance, and this is fine but it depends whether you want to protect your customers and your company as much as possible. One of the latest tactics which fraudsters use in their arsenal to intrude on credit card holder data is called ‘social engineering’ and it takes advantage of well meaning employees. The PCI DSS guidelines began with 5 different programs run separately by Visa, Mastercard, American Express, Discover and JCB, but in December 2004 these companies combined their individual policies to form the PCI Data Security Standards Council. The first update was V1.1 in 2006, followed by V.1.2 in 2008 and the current version V.2.0 which was released in October 2010 states that all merchant’s must be compliant with these changes by January 2012.

The aim of these updates are to help your business re-evaluate itself and addresses many technical issues such as installing a firewall on PC’s that send data over a network, encryption of data being sent and monitoring all PIN entry devices for foreign attachments used for ‘skimming’.  The latter are all vital, but in V.2.0 they have began to touch on ‘social engineering‘ in Test Procedure 6.5.8: ‘Properly authenticate users’ and this new information should also be recorded in your documentation.

Internet Merchant Account

 

An internet merchant account is a crucial part of running an online business, so even if you’ve established which virtual terminal and shopping cart you want to use, the payment service provider will require that you apply for a merchant bank account.

Sagepay

 

The Sage Group PLC is a software company which has its headquarters in Newcastle upon Tyne, United Kingdom, but is world renowned for its innovations in resource planning computer systems. The business was co-founded in 1981 by David Goldman who at the time was running a printing company, it was here that he was to test some accounts estimating software developed by University student Graham Wylie.

The online payment system works when a customer selects the products they wish to purchase from your website and their card details are captured securely by Sagepay.

You can choose to request the customer enters their ‘Verified by Visa and Mastercard’ security code, this will appear on their card issuers page (i.e RBS, Natwest).

Sagepay will send the transaction details to your merchant account who will in turn request authorization from the issuing bank, the results will be relayed back and Sagepay will notify the merchant whether the payment was authorized or declined.

Twin data centres mean that if for any reason there is problem with one, the other takes over as automatic disaster recovery operation and this ensures that your transactions will be processed 24 hours a day, 365 days a year.  The funds accumulated from all payments are sent to your merchant bank for settlement at the end of each day, the money is then collected from the customers issuing banks and is delivered to your bank account.

Payment Gateway

 

A payment gateway is a form of online service that provides merchants with the ability to trade via the internet. Websites operate in much the same manner as a manual catalogue; cardholders select what goods or services they wish to purchase, before being redirected to a secure payment page that acts as a checkout for this virtual terminal. Payment processing works in largely the same way as when accepting physical credit card payments, but for the added role of the Payment Service Provider (PSP), which presents customers with an authentication page, as well as safely transferring card details to the merchant’s acquiring bank. The bank passes them on, in turn, to the respective card issuer for authorisation and confirmation is sent back to the merchant, again via the PSP. It is important to note, however, that PSPs do not contribute to the design or creation of the actual website.

All CNP (Cardholder Not Present) transactions are subject to a number of risks of fraud. There are several measures that merchants can take to reduce these possibilities, should they wish to accept credit cards over the internet:

3D Secure – perhaps the most common form of online fraud prevention is MasterCard SecureCode/Verified By Visa. These work like chip and pin machines, requesting that customers provide a form of security code before proceeding with a virtual transaction.

Fraud screening – this technology works by scanning for recognised patterns in cardholders’ transactions before details are passed to a card issuer. The merchant is alerted to any suspicious data and advised as to whether or not to accept credit card payments. This can also be used as an effective tool against any threat of chargeback. Merchant account providers, PSPs and specialised third parties can provide this service.

AVS/CSC – as previously discussed, this system allows merchants to seek immediate advice from their acquiring bank on whether to accept a particular transaction, often through their own credit card terminals.
